Innocent Spouse Relief

What should a person do when their spouse has engaged in questionable tax practices?  It is not uncommon for one spouse to create a significant tax burden for through his or her aggressive or downright fraudulent tax compliance.  Recognizing this problem, Congress has created the Innocent Spouse rules.  Under the right circumstances, these rules allow an "innocent" spouse to obtain relief from these liabilities.

The 1998 IRS Restructuring and Reform Act made important and fundamental changes to how an innocent spouse applies for this relief.  In many ways, it has become a far simpler procedure.  However, there are also new pitfalls that may result in denial of relief.
